Supreme Court upholds status quo on BFAA general secretary post
The Appellate Division of the Supreme Court (SC) today upheld the status quo passed by its chamber-judge court on the post of general secretary of Bangladesh Film Artistes’ Association (BFAA).
The apex court came up with the order after disposing of leave to appeal the petition of Nipun Akter. The court also asked the High Court to hold a hearing on a rule issued in this regard earlier.
“Disposed of. The order dated February 9 passed by the learned judge-in-chamber shall continue till the hearing of the writ petition no. 1953 of 2022,” the order of the six-member Appellate Division bench headed by Chief Justice Hasan Foez Siddique said.
“The High Court is scheduled to hold a hearing on its rule on February 15,” petitioner Nipun Akter’s lawyer Barrister Rokon Uddin Mahmud said.
The Appellate Division Chamber Judge Court on February 9 imposed the status quo on the post and also stayed a High Court order that had stayed the decision of an appellate board that revoked the candidacy of Zayed Khan in the recently held BFAA polls and declared Nipun Akter as the general secretary of the association.
Justice Obaidul Hassan of the Appellate Division Chamber Judge Court passed the order after holding a hearing on a petition of Nipun, challenging the February 7 High Court order.
The Appellate Division Chamber Judge Court is also set today to hold a further hearing on the matter at the Appellate Division full bench.
Advocate Rokon Uddin Mahmud argued for the petition of Nipun Akter, while Advocates Yusuf Hossain Humayun, Ahsanul Karim and Nahid Sultana Juthi stood for Zayed Khan.
The High Court on February 7 stayed the decision of an appellate board that canceled the candidacy of Zayed Khan in the recently held Bangladesh Film Artistes’ Association polls and declared Nipun Akter as the general secretary of the association.
The court also issued a rule asking authorities concerned to explain in a week as to why it shall not declare illegal a letter of Department of Social Services giving the ultimate authority to the appellate board in taking such a decision, and the decision of the appellate board, canceling the candidacy of Zayed Khan.
