HC verdict legalising Zayed’s election as BFAA’s GS stayed

The Appellate Division of the Supreme Court (SC) Sunday stayed for four weeks a High Court order that declared illegal the decision of an appeal board, cancelling the candidacy of actor Zayed Khan in the recently held Bangladesh Film Artistes’ Association (BFAA) polls.

Justice Obaidul Hassan of the Appellate Division Chamber Judge court passed the order after holding hearing on an appeal filed by actress Nipun Akter against the High Court verdict.

The apex court also imposed a status quo on the post of general secretary of the BFAA. The court asked Nipun to file a leave to appeal petition against the High Court order, sending the matter to Appellate Division full bench for further hearing on April 4.

The High Court (HC) on March 2 had come up with its verdict, declaring absolute a rule issued earlier in this regard.

Barrister Rokon Uddin Mahmud and Mustafizur Rahman Khan argued for Nipun Akter, while Advocates Ahsanul Karim and Nahid Sultana Juthi stood for Zayed Khan.

The High Court on February 7 stayed the decision of an appeal board that cancelled the candidacy of Zayed Khan and declared Nipun Akter as the general secretary of the association.

The court also issued the rule asking authorities concerned to explain in a week as to why it shall not declare illegal a letter of Department of Social Services giving the ultimate authority to the appellate board in taking such a decision, and the decision of the appeal board, cancelling the candidacy of Zayed Khan.
